These general terms and conditions of sale (“T&Cs”) govern all sales of products concluded on the France Nichoirs website (the “Site”) between DM DÉVELOPPEMENT, a SARL with share capital of €500.00, registered with the Douai Trade and Companies Register under no. 885 090 159, whose registered office is located at 40 rue de la Cossetterie, 59870 Marchiennes, France (the “Seller”), and any person making a purchase on the Site, whether a consumer or a professional (the “Customer”). Placing an order implies unreserved acceptance of these T&Cs.
The products offered for sale are nest boxes and accessories designed to accommodate wildlife on buildings, manufactured in France. Their essential characteristics (dimensions, materials, certifications, installation conditions) are set out on each product page and in the downloadable technical data sheets. Photographs illustrate the products as faithfully as possible but are not contractually binding, as slight variations in appearance may occur (shades, natural materials such as terracotta).
Prices are expressed in euros, including all taxes (VAT included) for consumers. Professional customers holding an approved business account benefit from specific pricing conditions (prices excluding VAT, volume-based discounts, with minimum order quantities) visible after logging in to their account. Delivery charges are indicated before final confirmation of the order. The Seller reserves the right to change its prices at any time; products are invoiced at the price in force when the order is confirmed.
An order is confirmed once the cart has been validated, these T&Cs accepted and payment made in full. A confirmation email summarising the order is sent to the Customer. The Seller reserves the right to refuse any abnormal order or order placed in bad faith, or in the event of a previous dispute. For professional customers, minimum order quantities apply per product reference, as indicated in their account.
Payment is made online, in full, at the time of ordering, using the secure payment methods offered on the Site. Payment data is processed in encrypted form by the payment service provider; the Seller never has access to it. If authorisation is refused, the order is automatically cancelled.
Products are made to order in the Seller's partner workshops. The current manufacturing lead time is approximately 4 weeks from receipt of the order, plus delivery by carrier within 48 hours of collection. These lead times are indicative; the Customer will be informed of any significant extension. In accordance with Article L.216-1 of the French Consumer Code, if delivery has not taken place at the latest 30 days after the indicative date communicated, the consumer may terminate the order under the conditions provided by law, after having requested the Seller to deliver within a reasonable additional period.
Delivery is made to the address provided by the Customer, in mainland France.
Upon receipt, the Customer must check the condition of the products in the presence of the carrier and, where applicable, record specific reservations on the delivery note, confirmed to the Seller within 3 working days (Article L.133-3 of the French Commercial Code for professionals).
In accordance with Articles L.221-18 et seq. of the French Consumer Code, consumers have a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to give reasons, by informing the Seller by any unambiguous statement (for example by email to mddeveloppement@outlook.fr) or using the standard withdrawal form. Products must be returned complete, uninstalled and in their original packaging within 14 days of notification; return costs are borne by the consumer. Refunds are made within 14 days of recovery of the goods or proof of their dispatch.
Exception: in accordance with Article L.221-28 3° of the French Consumer Code, the right of withdrawal does not apply to products made to the Customer's specifications or clearly personalised (in particular RAL lacquered finishes and colours produced on quotation).
All products benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code — 2 years from delivery for consumers) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of a lack of conformity, the consumer may choose between repair and replacement of the goods, free of charge, under the conditions provided by law. Products remain the property of the Seller until full payment of the price. Risk passes upon delivery of the products to the Customer (or, for professionals, upon handover to the carrier when transport is arranged by the Customer).
Products must be installed in accordance with the installation recommendations set out on the product pages and technical data sheets. The Seller cannot be held liable in the event of non-compliant installation, modification of the product or abnormal use. In any event, the Seller's liability in respect of a professional order is limited to the amount of that order.
The data collected in connection with the order is necessary for its processing and is managed in accordance with the Site's Privacy Policy and the GDPR.
In the event of a complaint, the Customer is invited to first contact customer service (mddeveloppement@outlook.fr). Failing an amicable resolution, the French courts shall have jurisdiction; for professionals, exclusive jurisdiction is granted to the commercial court with jurisdiction over the Seller's registered office.
These T&Cs are governed by French law. The language of the contract is French.
